I. Basic Provisions
The controller of personal data according to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”) is LuMa Elektro s.r.o. (hereinafter referred to as the “controller”).

Personal data means any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to a commonly used identifier, or other identifier such as name, surname, identification number, location data, online identifier, or by reference to one or more elements specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
The controller has not appointed a data protection officer.
II. Sources and Categories of Processed Personal Data
The controller processes personal data that you have provided or personal data obtained in connection with the fulfillment of your order.
The controller processes your identification and contact data and data necessary for contract performance.
III. Legal Basis and Purpose of Personal Data Processing
The legal basis for processing personal data is:

Performance of a contract between you and the controller according to Article 6(1)(b) of the GDPR,

The legitimate interest of the controller in direct marketing (particularly sending commercial offers and newsletters) according to Article 6(1)(f) of the GDPR,

Processing is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract.
The purpose of processing personal data is:

Processing your order and fulfilling rights and obligations arising from the contractual relationship between you and the controller; personal data required for a successful order (name, address, contact) are necessary for concluding and fulfilling the contract. Without providing personal data, it is not possible to conclude the contract or for the controller to fulfill it.

Sending commercial offers and carrying out other marketing activities.
There is no automated individual decision-making by the controller as per Article 22 of the GDPR. You have explicitly consented to such processing.
IV. Data Retention Period
The controller stores personal data:

For the period necessary to fulfill rights and obligations arising from the contractual relationship between you and the controller and to enforce claims from such contractual relationships (for 15 years after the contract ends).

For the period until the consent to process personal data for marketing purposes is revoked, for a maximum of 15 years, if the data is processed based on consent.
After the retention period, the personal data will be deleted.
V. Recipients of Personal Data (Controller’s Subcontractors)
Recipients of personal data include persons:

Involved in the delivery of goods/services and processing payments based on a contract,

Providing services related to the operation of the e-shop or associated services,

Providing marketing services.
The controller does not intend to transfer personal data to a third country (outside the EU) or to an international organization.
Services used for marketing and support purposes include:

Google Shopping – sends review requests, records email if consent is given during the order process

Heureka – records purchase conversions and email for the “Verified by Customers” service

VI. Your Rights
Under the conditions set out in the GDPR, you have the right to:

Withdraw consent to processing at any time by written or electronic request sent to the controller’s address or email listed in Article III. Consent can also be withdrawn at any time via your customer account.
If you believe that your rights under personal data protection laws have been violated, you have the right to file a complaint with the Data Protection Authority.
VII. Personal Data Security Conditions
The controller declares that all appropriate technical and organizational measures have been taken to secure personal data.
These measures include securing data storage and personal data in physical form, secured/encrypted website access, password encryption in the database, regular system updates, and regular backups.
Only authorized persons have access to personal data.
VIII. Final Provisions
By submitting an order via the online form, you confirm that you are familiar with the personal data protection terms and fully accept them.
You agree to these terms by checking the consent box on the website form. By checking this box, you confirm your understanding and acceptance of the data protection terms.
The controller reserves the right to amend these terms. The new version of the data protection policy will be published on the website and also sent to your email address provided to the controller.
These terms are effective as of May 22, 2025.
